Terms and Conditions

These Terms and Conditions (“Terms”) set out the basis on which TNT Marketing Ltd, trading as Debriefed.co.uk(“we, us, or our”), sells goods (“Goods”) through our website, www.debriefed.co.uk (“our site”).

Please read these Terms carefully before placing an order. By using our site or purchasing any Goods, you acknowledge that you have read, understood, and agree to be bound by these Terms.

We manufacture and supply apparel, accessories, cosmetics, and related lifestyle goods, many of which are produced within the United Kingdom.

2. Definitions

For the purpose of these Terms:

  • “You”, “Your” or “Customer” refers to the person or entity purchasing Goods from our site.
  • “Contract” means the agreement formed between you and us upon dispatch confirmation.
  • “Working Day” means any day other than Saturday, Sunday or a public holiday in England.
  • “Consumer” means an individual acting for purposes wholly or mainly outside their trade, business or profession.

3. Eligibility to Purchase

By placing an order with us, you warrant that:

  1. You are at least 18 years of age and legally capable of entering into binding contracts;
  2. The personal and payment information you provide is accurate and complete;
  3. You are the authorised holder of the payment method used;
  4. You will not use the Goods for any unlawful, unsafe, or commercial purpose; and
  5. You have made all necessary checks to ensure the Goods are suitable for your intended use.

Any order placed using false or misleading information constitutes fraud and may result in legal action.

4. Formation of Contract

  • Your order constitutes an offer to purchase Goods.
  • We will acknowledge receipt by email, but this acknowledgment does not constitute acceptance.
  • Acceptance occurs only when we send a dispatch confirmation email, at which point a binding contract is formed.
  • We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, product unavailability, or regulatory restrictions.

5. Description and Accuracy of Information

We take reasonable care to ensure all product descriptions, prices, and details on our site are accurate. However:

  • Colours, shades, and materials may vary slightly from images shown due to photography, lighting, and display differences.
  • Measurements and weights are approximate.
  • We reserve the right to modify specifications without notice in the interests of product improvement or compliance.

 

Our garments are crafted using high-quality stretch fabrics and premium woven elastics. Due to the natural properties of elasticated materials and the hand-assembly process involved, variations in waistband  text alignment, tension, or pattern continuity may occur. These subtle differences are inherent to the manufacturing process and reflect the individuality of each piece. They are considered a feature of authentic production, not a defect or fault, and do not affect the fit, comfort, or durability of the garment.

6. Prices and Payment

  • All prices are shown in GBP (£) and include VAT where applicable.
  • Delivery charges are calculated at checkout and displayed before purchase.
  • We accept major credit and debit cards, PayPal, and any other payment methods listed on our site.
  • All payments must be cleared before dispatch.
  • If a pricing error is identified, we will contact you to confirm whether you wish to continue with the order at the correct price or cancel it.

We are not obliged to fulfil any order placed at an incorrect price.

7. Delivery and Risk

  • Delivery dates provided are estimates and not guaranteed.
  • Risk in the Goods passes to you once they are delivered to your address or left in a safe place designated by you.
  • Title in the Goods passes only once full payment has been received.
  • We are not liable for any loss or damage resulting from delays, failed deliveries, or events beyond our reasonable control (see Force Majeure below).

If your order is not received within the expected time, please notify us promptly.

8. Right to Cancel (Consumer Rights)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your purchase within 14 days of receiving your order.

  • You must notify us in writing or by email within this period.
  • Goods must be returned within 14 days of cancellation in their original, unused condition, with packaging and tags intact.
  • You are responsible for return postage unless the Goods are faulty or incorrectly supplied.
  • Refunds will be issued using your original payment method within 14 days of receipt of the returned Goods.
  • We reserve the right to deduct an appropriate amount for any signs of wear, damage, or diminished value.

9. Product Use, Safety, and Customer Responsibilities

9.1 General Use and Safety

Our Goods are designed for normal personal use. By purchasing and using our products, you agree to:

  • Inspect all items immediately upon delivery for defects or damage;
  • Use all Goods only for their intended purpose, following any care, maintenance, or safety instructions supplied;
  • Take reasonable precautions and exercise good judgment before use;
  • Ensure that the environment and conditions of use are safe and appropriate; and
  • Dispose of packaging responsibly and keep small items away from children and pets.

We are not liable for any accident, injury, or damage arising from:

  • Improper, unsafe, negligent, or unlawful use of the Goods;
  • Failure to follow care or safety instructions;
  • Alteration, modification, or misuse of the Goods; or
  • Use of the Goods in combination with other materials or substances not supplied by us.

9.2 Cosmetics and Skin Products

For all cosmetics, fragrances, or skincare products supplied through our site:

  • Perform a patch test on a small area of skin at least 24 hours before full use.
  • Do not apply to broken, irritated, or sensitive skin.
  • Avoid contact with eyes and mucous membranes.
  • Discontinue use immediately if irritation or reaction occurs and seek medical advice.

You acknowledge that individual sensitivities, allergies, and skin conditions vary, and that you are solely responsible for assessing suitability before use.

We expressly disclaim any liability for:

  • Skin irritation, allergic reaction, or injury resulting from use or misuse;
  • The effects of using our products alongside other cosmetics, medications, or substances; or
  • Any outcome arising from failure to carry out a patch test or to follow product guidance.

All cosmetic products comply with UK Cosmetic Product Safety Regulations and are intended for external use only.

10. Returns and Refunds

We comply fully with the Consumer Rights Act 2015.
If the Goods supplied are faulty, damaged, or not as described:

  • Notify us within 14 days of receipt;
  • Provide photographic evidence where possible; and
  • Return the Goods for inspection.

Upon verification, we will offer a repair, replacement, or refund (including reasonable return postage).
We do not accept returns for products that have been used, worn, or opened for hygiene reasons unless proven faulty.

11. Limitation of Liability

To the maximum extent permitted by law:

  1. Our total liability, whether in contract, tort, negligence, or otherwise, shall be limited to the price paid for the Goods.
  2. We shall not be liable for:
  • Any indirect, consequential, or incidental losses;
  • Any injury, allergic reaction, health issue, or damage resulting from misuse, neglect, modification, or failure to follow instructions;
  • Any data loss, business interruption, or loss of revenue or profit;
  • Any act or omission of couriers, postal services, or third-party delivery agents;
  • Any damage or deterioration arising after delivery.

 Nothing in these Terms shall exclude liability for:

  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation; or
  • Any matter for which liability cannot lawfully be excluded under UK law.

You agree to indemnify, defend, and hold harmless TNT Marketing Ltd, its directors, employees, and affiliates against all claims, losses, damages, costs, or expenses (including legal fees) arising from your misuse of the Goods or breach of these Terms.

12. Warranties and Fitness for Purpose

Unless expressly stated, we make no warranties or representations regarding:

  • The fitness of any Goods for a particular purpose;
  • Compatibility with other products; or
  • Performance beyond normal domestic use.

All implied warranties, including those of merchantability and fitness for purpose, are excluded to the fullest extent permitted by law.

13. Intellectual Property

All content on our site, including but not limited to text, images, graphics, design, product names, and logos, is the intellectual property of TNT Marketing Ltd or its licensors.

You may not reproduce, distribute, modify, or use any part of our content for commercial purposes without our prior written consent.

14. Data Protection and Privacy

Your personal data is processed in accordance with our Privacy Policy. By using our site, you consent to such processing and warrant that all information provided is accurate.

We will never sell or share your personal data with third parties other than where necessary to fulfil your order or comply with legal obligations.

15. Force Majeure

We are not liable for any delay or failure to perform any obligation due to events beyond our reasonable control, including but not limited to:

  • Natural disasters, pandemics, or extreme weather;
  • Strikes or labour disputes;
  • Transport or supply chain disruptions;
  • War, terrorism, or government restrictions.

In such cases, performance will be suspended for the duration of the event, and we will endeavour to fulfil our obligations as soon as reasonably practicable.

16. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Governing Law and Jurisdiction

These Terms and any dispute arising out of them shall be governed by and construed in accordance with the laws of England and Wales.
You agree to submit to the exclusive jurisdiction of the courts of England and Wales.
